That one is a multi-part encode. Since the sections are extracted one-at-a-time there is lots of chance for missing the chance to "extract" rather than encode. Also, they would have to all be small enough to fit (you can't just encode one section, or the quality would not be consistent).

I'll look at it and see if I can come up with a better way to project size on muli-part sources.

As for the sync problem -- I think that was probably fixed with v0.33.09. It turns out that using the internal FFMS in X264 for frame-serving on multi-part sources wasn't as great an idea as I originally thought -- but encoding from the demuxed source rather than the original M2TS seems to have fixed it.
