the container or the h264 video codec? the h264 codec patents are licensed by the MPEG-LA.

The container, I presume.
H.264 is not the only type of video stream allowed in MP4 files...

The container itself comes directly from Apple's QuickTime container (*.mov).

It's over twenty years old. Whatever patents there ever were, have expired.

Remember that I'm talking about the container - not the content.
