Why not?

Baseline profile probably is a limitation of the platform. But shouldn't we be happy that they use a good encoder at least?

You should remove that link to the PS3 forum so doom9 doesn't get infected with stupid.

Is he asking if the profile is compatible with PS3? or is he asking is it ok to use x264 commercially by Atari?

1. The provided info indicates they are using Baseline profile. If that profile isn't "compatible", what else?

2. The GPL explicitly allows using the software for commercial purposes. As long as they don't incorporate x264's code into their own proprietary software, everything is fine.

(Regardless of what H.264 encoder software they use, they may have to pay patenting fees to the MPEG-LA for using H.264 videos in their product though)

Actually I'm a little perplex about the container, the file has .mkv extension (if it's not been renamed by those guys) but mediainfo says that it's an AVI file. They used a really simple setting so I suppose that it won't cause any harm (no b-frames and only 1 reference frame), anyway it's a bizarre choice.

These are the restrictions of the PS3 "media center" (or whatever Sony calls it). Game developers aren't limited by Sony's software though, they can implement any decoder they want in their own software.
